This Refund Policy outlines the terms under which refunds may or may not be provided for services purchased through Illaka (operated at illaka.in). By purchasing or subscribing to any of our services, you acknowledge and agree to this Refund Policy.
⚠️ Please read this policy carefully before making any payment. All payments are generally considered final once the corresponding service has been delivered or work has commenced.
1. General Policy
Due to the nature of our services — which involve digital content creation, web design, and platform access — all payments are generally non-refundable once the service has been delivered, the Business Page has been published, or work has commenced on your project. We invest significant time and resources into creating each Business Page, and charges reflect this effort.
2. Subscription Plans (Pro Plan)
Annual Subscription Fee
- The annual subscription fee covers the hosting and maintenance of your Business Page for the subscription period.
- No refunds will be provided for partial or unused subscription periods.
- If you cancel your subscription, your Business Page will remain active until the end of the current billing period, after which it will be taken down.
One-Time Setup Fee
- The setup fee covers the design, development, and initial configuration of your Business Page.
- The setup fee is non-refundable once work has commenced on your Business Page, regardless of whether the page has been published or not.
- If we have not yet commenced any work on your Business Page, a refund of the setup fee may be considered on a case-by-case basis at our sole discretion.
3. E-commerce Setup (Shopify Store)
- Due to the customized nature of e-commerce store setup, payments for Shopify store setup services are strictly non-refundable once work has begun.
- If you request cancellation before any work has commenced, a partial refund may be considered at our sole discretion, subject to a minimum 25% administrative fee.
- Illaka is not liable for any issues arising from the Shopify platform itself, third-party apps, payment gateways, or any other services not directly provided by Illaka.
4. Booking App Services
- Refund terms for Booking App services will be determined on a case-by-case basis as per the specific agreement or quotation provided to you.
- Any commission-based arrangements are non-refundable as they are tied to actual transactions.
- Monthly subscription fees for Booking App services, once charged, are non-refundable for that billing period.
5. Circumstances Where Refunds May Be Considered
We may consider a refund at our sole and absolute discretion in the following limited circumstances:
- If we fail to deliver any service and have not commenced any work whatsoever.
- If a duplicate or erroneous payment was made (with verifiable proof).
Even in the above cases, refund approval is not guaranteed and will be evaluated on a case-by-case basis.
6. Refund Process
- To request a refund, you must contact us through our contact form within 7 days of the payment date.
- Refund requests made after 7 days from the payment date will not be entertained under any circumstances.
- If a refund is approved, it will be processed within 15–30 business days and credited back to the original payment method.
- Any applicable payment gateway charges or processing fees may be deducted from the refund amount.
7. Service Modifications & Dissatisfaction
- If you are not satisfied with the design or content of your Business Page, we will make reasonable modifications as part of our service. However, dissatisfaction with design or styling alone does not constitute grounds for a refund once the page has been delivered.
- We offer up to 2 rounds of revisions for Business Pages. Additional revisions may be charged separately.
- Refunds will not be provided for minor design preferences, subjective opinions, or changes requested after the revision period.
8. Disclaimer of Liability
Illaka shall not be held responsible or liable for any direct, indirect, incidental, consequential, special, or exemplary damages, losses, or expenses arising from or related to:
- Any business losses, loss of revenue, loss of profits, loss of anticipated savings, loss of goodwill, or loss of data resulting from your use or inability to use our Services.
- Any downtime, interruption, or unavailability of your Business Page or our platform.
- Any failure to achieve expected business results, customer engagement, or online visibility through our Services.
- Actions or omissions of third-party service providers, including but not limited to hosting providers, payment gateways, domain registrars, and platform providers (e.g., Shopify).
- Any unauthorized access, data breaches, or security incidents beyond our reasonable control.
- Any reliance you place on information or content provided through our Services.
9. No Guarantee of Results
Illaka does not guarantee any specific business outcomes, including but not limited to increased traffic, customer inquiries, sales, revenue, search engine rankings, or any other measure of business success. Our Services are limited to creating and hosting your Business Page. The performance of your business is solely your responsibility.
10. Chargebacks
If you initiate a chargeback or dispute with your bank or payment provider instead of contacting us first, we reserve the right to suspend or permanently terminate your account and remove your Business Page without notice. We also reserve the right to recover any costs incurred as a result of the chargeback process.
11. Changes to This Policy
We reserve the right to update or modify this Refund Policy at any time without prior notice. The most current version will always be posted on this page with an updated "Last updated" date. Your continued use of the Services or subsequent purchases constitute your acceptance of the revised policy.
12. Governing Law
This Refund Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this policy shall be subject to the exclusive jurisdiction of the courts located in India.
